A new European Union directive is set to transform how consumers in Spain and across the bloc repair their smartphones, making the process simpler, more transparent, and less dependent on manufacturers. The directive, formally known as Directive (EU) 2024/1799, was published in Spain's Official State Gazette (BOE) and establishes common rules to promote the repair of consumer goods. While the legislation covers a wide range of products, its impact on the smartphone sector is particularly significant, as many repairs have been hindered by high parts costs, limited technical information, and restrictions imposed by manufacturers.
The directive entered into force in 2024, but its provisions must be applied by member states starting July 31, 2026. One of the most important changes for consumers will be the introduction of a standard European repair information form. This form is designed to provide clear details about the type of fault, the price, the expected timeline, and any additional costs. In practice, this aims to prevent a common scenario where a consumer receives a vague estimate from a repair service and ends up buying a new phone because the repair seems too expensive or unreliable. The underlying philosophy is to make repairing a device a real, understandable, and competitive option.
The directive's core objective is to reduce the premature disposal of still-usable goods and allow consumers to request an affordable repair from the service provider of their choice. This shift is linked to broader goals of sustainable consumption, reducing waste, and decreasing the need to manufacture new products to replace defective ones. The legislation explicitly targets technical barriers that have long frustrated independent repair shops and consumers alike.
For smartphones, the most relevant part of the directive addresses technical obstacles. According to the BOE, manufacturers must not use contractual clauses or techniques related to hardware or software that prevent the repair of products subject to EU reparability requirements, unless there are legitimate and objective reasons. This targets practices such as limiting the use of compatible parts, hindering the work of independent repairers, or making a replaced component perform worse if it is not sourced through the brand's authorized channels. The directive specifically targets software or firmware barriers that block repairs without justification. Exceptions are allowed for legitimate reasons, including the protection of intellectual property rights, but these restrictions cannot be used as a general way to close the repair market or discourage consumers from seeking alternative services.
Beyond the right to repair directive, the EU has also approved Regulation (EU) 2023/1542 on batteries and waste batteries, another key piece for the future of smartphones. This regulation, already in force, introduces progressive obligations to improve battery sustainability and management. For phones and other devices, the most notable milestone is February 2027, when manufacturers must move toward batteries that are more easily removable and replaceable by users. This measure targets one of the most common reasons a phone becomes unusable before its time: a degraded battery that is not worth replacing.
The change is profound because it affects device design. For years, many smartphones have been manufactured as nearly sealed products, with adhesives, integrated parts, and complex repairs. The new direction set by Brussels is the opposite: extend the product's useful life, reduce electronic waste, and give consumers more decision-making power before buying a new phone. The combination of these regulations is expected to foster a more competitive repair market, lower costs for consumers, and contribute to environmental sustainability across the European Union.
